Terms of Use

1. Acceptance of Terms

By downloading, installing, or using GlucoFlow ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and GlucoFlow ("we," "us," or "our").

2. Medical Disclaimer

Estimated HbA1c Calculation

The estimated HbA1c feature uses a standard mathematical formula based on your average glucose readings. This is an estimation only and may not accurately reflect your actual HbA1c level. Always rely on laboratory blood tests conducted by healthcare professionals for accurate HbA1c measurements.

Glucose Monitoring

GlucoFlow is designed to help you log and track glucose readings obtained from approved glucose monitoring devices. The App does not measure glucose levels directly. You are responsible for:

• Using properly calibrated and approved glucose monitoring equipment
• Entering accurate glucose readings into the App
• Following your healthcare provider's instructions for glucose monitoring
• Verifying all data entered into the App

3. Eligibility and User Responsibilities

Age Requirements

• You must be at least 13 years old to use GlucoFlow independently
• Users under 18 should use the App under parental or guardian supervision
• Parents/guardians are responsible for monitoring their child's use of the App

Accurate Information

You agree to:

• Enter accurate and complete glucose readings
• Maintain the accuracy of your logged data
• Not use the App to store false or misleading health information
• Use the App as intended for diabetes tracking purposes

4. License and Permitted Use

License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on devices you own or control
• Use the App for personal, non-commercial diabetes tracking purposes
• Access features available in your subscription tier (free or premium)

Restrictions

You agree NOT to:

• Modify, reverse engineer, decompile, or disassemble the App
• Remove, alter, or obscure any proprietary notices from the App
• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to any portion of the App
• Use the App to transmit viruses, malware, or harmful code
• Sell, rent, lease, or sublicense the App to third parties
• Use the App for commercial purposes without our written permission
• Interfere with or disrupt the App's functionality or servers

5. Premium Subscription

Subscription Tiers

• Free Version: Access to core features including unlimited logging, basic charts, and widgets
• Premium Version: Additional features including extended date ranges, estimated HbA1c, professional reports, and priority support

Billing and Payment

• Premium subscriptions are billed through Apple's App Store
• Payment is charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage subscriptions and turn off auto-renewal in your Apple ID account settings

Refunds

• All subscription purchases are processed through the Apple App Store
• Refund requests must be submitted directly to Apple through their refund request system
• We cannot process refunds directly as we do not handle payment processing
• Apple's refund policies apply to all purchases

Free Trial

• If a free trial is offered, it will be clearly stated at the time of subscription
• You may cancel during the trial period to avoid charges
• If you don't cancel before the trial ends, you'll be charged the subscription fee
• Free trials are typically limited to one per user

6. Data Privacy and Security

Your privacy is critically important to us. Please review our Privacy Policy for detailed information about:

• How your health data is stored locally on your device
• Encryption and security measures we implement
• Optional iCloud sync functionality
• Data you can export and share
• Our commitment to never selling or sharing your personal health data

Your Data Ownership

You retain all rights to your health data logged in GlucoFlow. We do not claim ownership of your glucose readings, notes, or any other information you enter. You have the right to:

• Export your data at any time
• Delete your data from the App
• Control who you share your data with

7. User-Generated Content

Your Notes and Annotations

Any notes, tags, or annotations you add to your glucose entries:

• Remain your property and are stored locally on your device
• Should not contain personal information about others without their consent
• Should not contain offensive, illegal, or harmful content
• Are your responsibility to keep accurate and appropriate

Feedback and Suggestions

If you provide feedback, suggestions, or ideas about the App:

• We may use them to improve GlucoFlow without compensation to you
• You grant us a perpetual, worldwide license to use such feedback
• You represent that you have the right to provide such feedback

8. Intellectual Property Rights

The App and its original content, features, and functionality are owned by GlucoFlow and are protected by:

• International copyright laws
• Trademark laws
• Patent laws
• Other intellectual property rights

Trademarks

"GlucoFlow" and associated logos are trademarks of GlucoFlow. You may not use these trademarks without our prior written permission.

9. Third-Party Services and Links

Apple Services

The App integrates with Apple services including:

• Apple App Store - Subject to Apple's Terms and Conditions
• iCloud - Subject to Apple's iCloud Terms and Conditions (optional feature)
• Apple Health/HealthKit - Subject to Apple's policies (if you enable integration)

RevenueCat

Premium subscriptions are managed by RevenueCat. Their Terms of Service apply to subscription management.

External Links

The App may contain links to external websites or resources. We are not responsible for:

• The content or accuracy of third-party websites
• Privacy practices of external sites
• Any damages or losses caused by use of third-party content

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy, reliability, or completeness of content
• Uninterrupted or error-free operation

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GLUCOFLOW SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Medical complications or adverse health outcomes
• Decisions made based on App data or calculations
• Interruption of service or data loss
• Unauthorized access to your device or data

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM.

Essential Medical Limitation

You acknowledge that:

• GlucoFlow is a tracking tool, not a medical device
• You will not rely solely on the App for medical decisions
• You will consult healthcare professionals for medical advice
• You use the App at your own risk

12. Indemnification

You agree to indemnify, defend, and hold harmless GlucoFlow and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of third parties
• Any content you submit through the App (if applicable)
• Medical decisions made based on App data

13. App Updates and Modifications

Updates

We may release updates to improve functionality, fix bugs, or add features. You agree that:

• Updates may be required to continue using the App
• We are not obligated to provide updates indefinitely
• Older versions may become unsupported
• You should keep the App updated for security and performance

Changes to Terms

We reserve the right to modify these Terms at any time. When we do:

• We will update the "Last Updated" date
• Material changes will be announced in the App
• Your continued use after changes constitutes acceptance
• If you disagree with changes, you should stop using the App

14. Termination

By You

You may stop using the App at any time by:

• Uninstalling the App from your device
• Canceling any active premium subscription
• Deleting your local data (optional)

By Us

We may suspend or terminate your access if:

• You violate these Terms
• You engage in fraudulent activity
• You misuse the App in ways that harm us or other users
• Required by law or legal process

Effect of Termination

• Your license to use the App ends immediately
• You must stop using the App
• Data stored locally on your device remains yours
• Subscription fees paid are non-refundable unless required by law

15. Governing Law and Dispute Resolution

Governing Law

These Terms are governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to conflict of law principles.

Dispute Resolution

If a dispute arises:

1. Contact us first: Email support@glucoflow.app to attempt informal resolution
2. Mediation: If informal resolution fails, we agree to attempt mediation
3. Arbitration/Litigation: As a last resort, disputes will be resolved through binding arbitration or courts in [Your Jurisdiction]

Class Action Waiver

You agree to resolve disputes individually. You waive any right to participate in class action lawsuits or class-wide arbitration against GlucoFlow.

16. Apple-Specific Terms

Since GlucoFlow is distributed through the Apple App Store, the following terms apply:

Acknowledgement

• These Terms are between you and GlucoFlow, not Apple
• Apple is not responsible for the App or its content
• Apple has no obligation to provide support for the App

Scope of License

• You may use the App only on Apple-branded devices you own or control
• The license is non-transferable
• Usage must comply with Apple's Media Services Terms

Liability

• Apple is not responsible for claims relating to the App
• Apple is not responsible for intellectual property infringement claims
• All liability lies with GlucoFlow, not Apple

Third-Party Beneficiary

Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

17. Accessibility

We strive to make GlucoFlow accessible to all users. If you encounter accessibility barriers:

• Contact us at accessibility@glucoflow.app
• Describe the barrier you encountered
• We will work to address accessibility issues in future updates

18. Severability

If any provision of these Terms is found to be unenforceable or invalid:

• That provision will be limited or eliminated to the minimum extent necessary
• The remaining provisions will remain in full force and effect

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GlucoFlow regarding the App and supersede all prior agreements and understandings.

20. No Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
